Acceptance of Terms

These supplemental terms describe how Bloomforge LLC offers Bloom Voice ("the app"), alongside the license you accept from the app store when you install it. By using Bloom Voice you agree to them, to the extent they apply to you. If you do not agree, please do not use the app.

License Grant

Bloomforge LLC grants you a limited, personal, non-transferable, non-exclusive license to use Bloom Voice on devices you own or control, in accordance with these terms and the applicable platform terms (Apple Media Services Terms and Conditions for iOS, Google Play Terms of Service for Android).

If you obtained Bloom Voice through the Apple App Store, your license is also governed by Apple's Licensed Application End User License Agreement. These Terms of Service supplement that agreement and do not replace it.

Wellness Disclaimer

Bloom Voice is a wellness and practice tool, not a medical device. It is not intended to diagnose or treat any medical condition. For clinical voice therapy or guidance on voice-related medical decisions, consult a licensed speech-language pathologist or qualified medical professional.

Voice training can cause strain or injury if you push it. Stop practicing if you feel pain, tightness, hoarseness, or discomfort, and see a licensed speech-language pathologist or physician if symptoms persist or your voice does not recover. You know your own limits better than an app does, and practicing within them is your responsibility.

Apple's Licensed Application End User License Agreement has its own, broader restrictions on copying and reverse-engineering, and those apply too.

Future Paid Features

Bloom Voice may offer optional paid features in the future. These would be clearly identified, and your existing access to free features will not be removed or degraded to compel a purchase. Any in-app purchases will be processed through the Apple App Store or Google Play Store and are subject to the respective store's refund and billing policies.

Intellectual Property

All rights, title, and interest in Bloom Voice (including its design, code, branding, and documentation) belong to Bloomforge LLC. You retain full ownership of any voice recordings or content you create using the app. We claim no rights over your voice or personal data.

Disclaimers and Limitation of Liability

Bloom Voice is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. Some jurisdictions do not allow implied warranties to be excluded, or limits to be placed on a consumer's statutory rights, so parts of the above may not apply to you.

To the maximum extent permitted by applicable law, and except where the law does not allow liability to be limited, including cases involving personal injury, Bloomforge LLC's total liability to you for any claim arising from or related to your use of Bloom Voice shall not exceed the amount you paid for the app or $50 USD, whichever is greater. If you obtained Bloom Voice through the Apple App Store, Apple's Licensed Application End User License Agreement also applies to your license and carries its own limitation of liability.

Termination

You may stop using Bloom Voice at any time by uninstalling the app. Bloom Voice runs entirely on your device, with no accounts and no servers, so we have no way to suspend or revoke your access remotely. If you break these terms, your license to use the app ends and you should stop using it and remove it from your devices.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict-of-laws principles. Any dispute arising directly between you and Bloomforge LLC under these supplemental terms shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington. This does not affect Apple's Licensed Application End User License Agreement or the Apple Media Services Terms and Conditions, which continue to govern your license to use the app and carry their own governing-law and dispute-resolution provisions.
